Information on the status of the investigation of suspected cases

The German Environment Agency has received indications that irregularities have occurred in UER projects carried out in China. The German Environment Agency took these indications seriously and initiated formal investigations in accordance with the UERV to establish whether the indications were substantiated or could be substantiated.

If the reviews revealed that the approval requirements for a project activity had not existed or did not exist at the current time, the approval of the project activity would be withdrawn and the project would be terminated. No more UER certificates could be issued for emission reductions from the project activity anymore. If UER certificates have already been issued for the project activity in question, the security deposit will be utilised.

If the inspections and verification checks show that the inspection bodies have not performed their tasks in accordance with the standards on which their accreditation is based, the German Environment Agency is entitled to issue the necessary directives to rectify inspection deficiencies (cf. 45 (1) UERV). In the event of repeated or serious violations, the UBA may exclude individual inspectors from further inspections, submit a request to the German Accreditation Body (DAkkS) to verify the accreditation, revoke the registration of the inspection body under the UERV or exclude individual inspectors from further inspections.

General information

Companies that place liquid fuels on the market in Germany (quota holders) are subject to the obligation to reduce the greenhouse gas emissions of these fuels, in accordance with section 37a (1) and (4) of the Federal Immission Control Ordinance (BImSchG). Compliance with the reduction obligation will be verified by the biofuel quota office (Main Customs Office Frankfurt/Oder).

In the years 2020 to 2025, the greenhouse gas quota could partly be met by crediting upstream emission reduction (UER) certificates. UER certificates are certified upstream emission reductions achieved in climate protection projects in the upstream area of oil and gas production (“UER projects”).

This possibility of compliance is regulated in the provisions for crediting UERs to the greenhouse gas quota (UERV). Through requests submitted to the UBA, a climate protection project could receive approval as an UER project under precisely regulated conditions and generate UER certificates for achieved emission reductions if the project and the emission reductions were reviewed and confirmed by accredited inspection bodies.

Following the amendment of the UERV as of 08/06/2024, this option ended with the commitment year 2025. Since 02/07/2024, project applications can no longer be submitted to the UBA. The amendment also tightened the requirements that inspection bodies had to observe when reviewing and confirming projects and emission reductions.

Projects in the fuel sector

The Ordinance offsetting upstream emission reductions against the greenhouse gas quota (Upstream Emission Reduction Ordinance, UERV) regulates the offsetting of upstream emission reductions (UERs). Information on the greenhouse gas reduction quota and the amount and duration of the offsetting options can be found under "General information".

UERs are greenhouse gas emission reductions that take place before the raw materials for petrol, diesel and LPG fuels enter a refinery or storage facility. These include emission reductions attained by avoiding flaring of associated gases in crude oil production.

Emission reductions must be attained by a project activity approved by ourselves in order for UERs to be offset. UER certificates are issued in the UER Registry for verified UERs and may be used to meet part of the greenhouse gas quota. UER certificates can be transferred between lead partners of projects and obligated parties.

Project Cycle

UER project activities pass ten steps:

  1. Project development (lead partner of the project)

The lead partner of the project identifies and plans a project activity to reduce upstream emissions. They do not have to be subject to the greenhouse gas reduction quota themselves.

  2. Validation (Validation body)

The project design document has to be reviewed by a validation body which prepares a validation report on its findings.

  3. Application for approval of a project activity (lead partner of the project)

The lead partner of the project submits an application for approval of their project activity.

  4. Approval (German Environment Agency)

We will decide on the project application within two months of receipt of the completed application documents.

  5. Information on the offsetting period (lead partner of the project)

The lead partner of the project gives us information about the start of the offsetting period.

  6. Monitoring upstream emission reductions (lead partner of the project)

The lead partner of the project monitors the project activity according to the specifications of the methodology used and the Upstream Emission Reduction Ordinance (UERV).

  7. Verification (Verification body)

The upstream emission reductions (UERs) attained by the project activity must be verified by a verification body.

  8. Issuances UER certificates (lead partner of the project)

Within the UER Registry the lead partner of the project may issue certificates for verified upstream emission reductions (UERs) attained by the project activity.

  9. Issuance of UER certificates (German Environment Agency)

We will give clearance to issue upstream emission reduction certificates (UER certificates) within four weeks of receipt of the completed application documents.

  10. Review (German Environment Agency)

We review the verification report in terms of its correctness and completeness within one year of the end of the offsetting period on the basis of the documents presented and, if necessary, on site.

Important notes

  • Since 02/07/2024, no new project applications can be submitted, and since 01/06/2026, no further requests for the issuance of credits can be made. This website therefore now serves primarily for documentation and information purposes.
  • It is imperative that the application for approval of an UER project be submitted to us before the start of the project.
  • The offsetting period from a project is a maximum of one year. Regardless of how long a project is running, UER certificates can only be issued for UERs that will be attained during this one year. An extension of the offsetting period is excluded.
  • It is inadmissible to offset UERs attained by one and the same project under UERV in Germany and in other Member States. However, UER certificates issued according to UERV can be transferred to other EU Member States.
  • Before UER certificates can be issued, the lead partner of the project must provide a guarantee in the form of an absolute bank guarantee from a financial institution until we have concluded reviewing the verification reports, up to a maximum of one year after the end of the offsetting period.
  • Please also note the information for validation and verification bodies carrying out activities according to the German 'Ordinance offsetting upstream emission reductions against the greenhouse gas quota' (Upstream Emission Reduction Ordinance, UERV)’.
  • To change the lead partner, please use the Change in the Lead Partner form. Following the change, the new lead partner becomes the exclusive lead partner in charge of the project activity within the meaning of Section 2(8) UERV
  • A complete verification with an on-site inspection must be carried out for each verification period. An on-site inspection can therefore only be the basis for the verification of one verification period and cannot substantiate the verification of several verification periods. An appropriate time is within four weeks before or after the end of the verification period.
  • Geodata in all reports must be correct and complete.
  • Geolocated images must meet professional georeferenced data requirements. These requirements are significant images that are either satellite images with date, scale and tracing of the relevant infrastructure (including reference to other photos taken on site) and/or photos with date and metadata containing the geodata and timestamps.
  • These images should be submitted in electronic form with the aforementioned metadata.

Publications on the Project Database

Once we have approved a project, we will publish

  • the date of issue of the approval notice,
  • the annual upstream emission reduction UER in kilograms of carbon dioxide equivalent determined based on the calculation method.

If the lead partner of the project has expressed his consent in the application form, we will publish

  • the name and address of the lead partner of the project,
  • the method used.

We will publish the offsetting period of a project as soon as the lead partner of the project has told us in a binding manner.

We will publish a verification report, once we have given clearance to issue upstream emission reduction certificates.

UER Register

UER certificates were issued and transferred within the UER registry. Upon submitting a request to us, lead partners of project activities as well as subjects to the greenhouse gas quota, could obtain access to the UER registry. Third parties were not granted access to the registry. The Upstream Emission Reduction Ordinance did not allow for trading accounts as they are known within the EU ETS. Quota holders could fulfil up to 1.2 percentage points of their quota using UER by transferring a corresponding amount of UER certificates to the devaluation account of the biofuel quota authority in the UER register.

The allocation of UER certificates to the greenhouse gas quota has expired. Information on the UER registry is still available via the link below.
