Emissions Trading in Aviation: up-to-date information on the introduction of CORSIA (05/2018)

Dear Sir or Madam,

We would like to inform you about the state of the delegated legal act completing the Emissions Trading Directive, which the EU Commission will use to transpose the CORSIA regulations into European and national law (see our mailing of 11/07/2018). We would also like to emphasise that the EU Commission will adapt the Monitoring and Reporting Regulation (MRR) as part of the introduction of CORSIA.

Unfortunately, there are delays in both projects which are due to the ongoing coordination process within the EU Commission. Therefore no final information is currently available.

In accordance with our promise to keep you updated about the latest developments regarding the introduction of CORSIA (see our mailing of 16/05/2018), this information is provided to draw your attention to the points below. However, these points are subject to reservation because of the as yet unclarified final legal status and represent only the current status of information.

  • The rights and obligations of the EU ETS in intra-EEA traffic, including deadlines and surrender obligation, remain unaffected until further notice.
  • On 29/10/2018 a draft of the revised MRR was published.
  • Important: the adaptation of the MRR also requires an addition to the existing EU ETS Monitoring Plan Annual Emissions for all (European and non-European) aircraft operators for which Germany is responsible under the EU ETS. DEHSt will also provide an electronic form for this purpose in due course. DEHSt will inform you about the deadlines for the submission of the adapted monitoring plans as soon as final information on the MRR is available.
  • The competent authority for the approval of the updated EU ETS monitoring plan can be found in the Commission's list of the administering Member States.

Of relevance for German operators only:

  • Aircraft operators from all ICAO Member States are obliged to monitor their CO2 emissions from international aviation from 01/01/2019. Monitoring plans must be sent to the relevant national authority (for German operators: DEHSt) by 28/02/2019. Please consider this information in your planning procedure.
  • It is envisaged that you should only add new data about international flights to your existing EU ETS Monitoring Plan Annual Emissions under CORSIA. We will inform you in due course about the exact requirements after the adoption of the delegated legal act and provide you with an electronic form.
  • Monitoring plans for international flights under CORSIA will be approved by 30/04/2019, provided they can be approved.

DEHSt will inform you soon after the decision of the EU Commission on how to proceed. In addition, DEHSt is planning a virtual information event on the topic for all aircraft operators concerned by the beginning of next year.
