Allocation Ordinance ZuV 2012
The Allocation Ordinance 2012 - PDF, 122KB: Zuteilungsverordnung 2012 - ZuV 2012 (only available in German) was published on the 17/08/2007 and came into force on 18/08/2007. Along with the Law Enabling Changes in the Legal Framework for Emissions Trading in the Allocation Period 2008-2012 (including the Allocation Act ZuG 2012) (only available in German) which came into force on 11/08/2007, this provides the legal framework for the allocation of emission allowances during the second trading period. According to paragraph 14 of the Allocation Act, this marks the beginning of a three-month application period, ending on the 19/11/2007 at midnight. Allocation applications must be made using the electronic forms provided and verified by a verifying authority. Only if these are submitted in the prescribed electronic way within the deadline will emission allowances for the second trading period be allocated free of charge. Electronic forms will be available from the DEHSt Form Management System (FMS) from the end of August.
Guideline for the 2012 Allocation
You will find documents that give advice and support for installation operators about the allocation process. From now on, you will find a guideline containing extensive information about legal regulations and advice about data quality requirements. It gives an overview of the current allocation regulations in Germany (ZuG 2012 and ZuV 2012), enabling applicants to submit a correct application. The data required for the allocation application are explained The applicant must correctly categorize the installation in question according to the following criteria: is the installation legally subject to emissions trading? When was the installation commissioned? Have extensions been made? Which industry does the installation belong to? What requirements and special regulations apply? All this needs to be considered for a successful application and verification. Chapters 2 and 3 contain an overview of the key points and requirements for the application procedure. Chapters 4 and 5 provide guidance on the application process, explaining general and particular allocation regulations, while Chapter 6 of the Guideline elaborates on terminology used in the application procedure.
DEV Software
DEV software is already available: Forms Management System (FMS). The software must be used by installation operators who are either first applicants or have been asked by DEHSt to amend the data provided in order to comply with the Data Collection Ordinance (DEV). Due to the limited timescale for the allocation procedure, applicants who have been asked to amend their data using DEV software should send the amendments ahead of the actual allocation application. First applicants, on the other hand, should send their data in both formats simultaneously.
Electronic Interface for the Application Data Transfers
If you have data of relevance for the application stored in your own database using some other software application, you may import them into the DEHSt's Form Management System (FMS) via our XML Interface which has been established to simplify and speed up the application process. The XML Interface is available in German only.
Details of the Application Procedure
According to the German Greenhouse Gas Emission Allowance Trading Act (TEHG) and the Allocation Act of the relevant trading period, all operators of installations subject to emissions trading must apply for the allocation of emission allowances for the entire trading period to the German Emissions Trading Authority at the Federal Environment Agency.
DEHSt provides free software for the preparation of allocation applications - the form management system (FMS), a server-based application. It is accessible via the Internet and ensures that all legal requirements regarding contents and structure of the applications are met. Correct application of the software with the help of the accompanying documents should result in a complete and correct application. Supporting documentation is available on the DEHSt website. Electronic communication is run by the Virtual Post Office (VPS) with its mailbox applications, ensuring secure and legally valid communication.
Application Procedure

Step 1
The installation operator opens an online account. No local software installation is needed. An allocation application is created by filling the data into the forms provided. Existing internal data or data that have been created earlier using FMS can be imported via an XML interface. The allocation applications must be verified by a verifying authority. Once all the data have been entered, the operator passes on the editing rights to the entrusted verifying authority.
Step 2
The verifying authority also has an electronic FMS account to check and confirm the operator's data and certify the application. The completed allocation application is then provided as a zip file and sent to the operator through the Virtual Post Office (VPS). Only documents carrying a legally valid electronic signature can be sent through the VPS.
Step 3
The allocation application which has been signed by the verifying authority is forwarded to DEHSt by the operator using the VPS. Again, the document must carry a legally valid electronic signature.
Step 4
The DEHSt examines the application and calculates the number of allocations. An allocation notice will be sent to the operator, again using the VPS.
Manuals and Support for 2008-2012 Allocation Applications
Requirements for the collection of emission data according to the Allocation Act 2012 (ZuG 2012) are largely the same as for the allocation procedure in 2004 and emissions reporting in 2005 and 2006. The data will be collected using the well-established Forms Management System (FMS) which has been adapted to the 2008-2012 application procedure. It now provides for data verification by independent verifiers who have been named by DEHSt. Installation operators and verifiers correspond electronically through the Virtual Post Office (VPS). An XML interface is available to import data into FMS format.
